AFGE Seeks Urgent Legal Action to Block Further FEMA Staff Cuts
In a critical move, a coalition of unions and non-profit organizations is taking legal action to prevent the Federal Emergency Management Agency (FEMA) from resuming staff layoffs. The American Federation of Government Employees (AFGE) and its legal team have filed a lawsuit, requesting an emergency court order to halt the ongoing cuts that have raised significant concerns.
The lawsuit, filed recently, aims to stop FEMA from continuing the reductions that began in early 2026. This comes as a temporary pause was implemented due to a severe winter storm affecting the United States in late January. However, the storm's impact has not deterred the agency's plans, as indicated by recent court filings and anonymous sources.
This legal challenge is part of a broader lawsuit against the Trump administration's government-wide workforce cuts. AFGE argues that the FEMA cuts are unlawful and hinder the agency's ability to respond effectively to disasters. The proposed injunction seeks to prevent further cuts to the Cadre of On-Call Disaster Response/Recovery (CORE) staff, whose contracts were previously non-renewed.
The CORE staff, traditionally renewed for two- or four-year terms, have faced unprecedented changes under the Trump administration. Court declarations reveal that the agency started limiting new CORE renewals to just 180 days last year. This shift has led to a concerning trend, as evidenced by multiple sources and court filings, where CORE staff with expiring contracts are being cut, despite supervisors' efforts to extend their contracts.
Internal emails further highlight the extent of the cuts. FEMA officials, in a December workforce exercise, considered slashing up to 50% of the agency's staff in fiscal 2026, including a staggering 41% of CORE positions. This proposal raises serious questions about the agency's preparedness and ability to respond to emergencies.
The AFGE's press release emphasizes the urgency of the situation, stating that the plaintiffs believe FEMA intends to resume the cuts soon. The request for an emergency order aims to halt any new reductions and reverse all unlawful workforce cuts since January 1. This legal battle underscores the importance of protecting public services and ensuring FEMA's ability to fulfill its critical mission.
